Litigation in a pandemic

If you’re isolating at home exposed to ongoing disputes, there is now an avenue out.

The Family Courts have established a court list dedicated to urgent family law disputes that have arisen as a direct result of the COVID-19 pandemic. The list commenced on 29 April 2020 and is already functioning as lifeline for many struggling through in isolation.

How does this help you?

The criteria for the newly dedicated list are:

  • The application has been filed as a direct result of the COVID-19 pandemic;
  • The matter is urgent;
  • The application is accompanied by an Affidavit (using the COVID-19 template affidavit) that addresses all of the criteria;
  • If safe to do so, you have made reasonable attempts to resolve the dispute but you were unsuccessful; and
  • The matter can be dealt with using electronic means

You must satisfy all of the criteria to be eligible. If accepted your matter can be listed within 3 business days.

Common issues that the court is dealing with involve current difficulties with (a) supervised contact, (b) border restrictions, (c) medical needs, and (d) family violence.
