Whilst you may want to post photos of that Christmas party on your social media, beware – they may end up annexed to your ex’s affidavit in your family law case.

Whether you post about having a few too many drinks at Christmas time, being on an expensive holiday (when you say in Court that you are in a dire financial situation), engaging in shenanigans at your office Christmas party, or making a statement about your [insert profanity here] ex restricting the children’s time with you this Christmas, these posts and photographs can be taken from social media and placed in front of a Judge and end up having a detrimental effect on the outcome of your Court matter.

A few tips to avoid any such surprises:

  • Do not post things on yours or anyone else’s social media that you wouldn’t want ending up in an affidavit in your family law matter.
  • Don’t refer to your Court proceedings or your former partner on social media whatsoever or be a part of any such posts (e.g. through being tagged).
  • Change your privacy settings to the highest level available.
  • When in doubt, do not post!
